1. Agreement to these Terms

These Terms of Service (the "Terms") are a legal agreement between you and Labelz ("Labelz", "we", "us", "our"). They govern your access to and use of the Labelz mobile application, the labelzai.app website, and any related services, features, content and integrations (together, the "Service").

By downloading, installing, accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and age requirement

You must be at least 13 years old to use the Service. If you are between 13 and 17, you must have the permission of a parent or legal guardian, and they must have read and agreed to these Terms on your behalf. Labelz is not directed at children under 13 and we do not knowingly collect information from children under 13.

To purchase a subscription you must be of the age of majority in your jurisdiction and legally able to enter a binding contract.

Labelz is not a medical device, is not intended for clinical use, and is not suitable as the sole source of information for anyone with a severe, anaphylactic or life-threatening allergy. See section 5.

To use most features you need an account. You can sign up using an email magic link or by using Sign in with Apple or Sign in with Google. When you create an account you agree to:

4. What Labelz does (and does not do)

Labelz reads food, drink, cosmetic, personal care and household product labels using your phone camera and returns a personal verdict based on the dietary preferences, allergens and ingredient categories you select in your profile.

5. Health, allergen and medical disclaimer

Read this carefully. It is the most important section of these Terms.

Labelz provides general information only. It is not a medical service and does not provide medical advice, diagnosis or treatment. Always read the physical label on the product and, where relevant, consult a qualified healthcare professional, registered dietitian, allergist, dermatologist or pharmacist before relying on any information the Service provides.

Allergen warning

If you, a person in your household, or a person for whom you are purchasing has a severe, anaphylactic or life-threatening allergy, you must not rely on Labelz as the sole means of assessing a product. Ingredient panels can be outdated, incomplete, mis-printed or mis-read by OCR. Formulations change. Cross-contamination is not always declared. Manufacturers may not list trace ingredients. You must always read the physical label and, where in doubt, contact the manufacturer and your healthcare professional.

Pregnancy, infant feeding, medical conditions

Labelz does not take into account pregnancy, breastfeeding, age-specific nutritional needs, drug interactions, chronic illness, metabolic conditions or any other individual medical circumstance. Categories such as "Pregnancy-Safe" or "Sensitive Skin" are informational heuristics and are not clinical recommendations.

Skincare and cosmetics

Skin reactions, sensitivities and dermatological conditions require professional assessment. The Service does not replace patch testing, dermatologist consultation, or ingredient-level risk assessment for your specific skin and health profile.

By using the Service you acknowledge and accept that you are solely responsible for the decisions you make about what you consume, apply to your skin, or purchase.

6. Ingredient data and scan accuracy

The ingredient information shown in the Service is generated from a combination of your camera input (OCR), automated parsing, AI classification, our proprietary ingredient database, and third-party reference data. Every step of this pipeline can introduce errors. In particular:

7. Subscriptions, billing and free trials

Some features of Labelz require an active paid subscription. We currently offer monthly and annual subscription plans. Prices are shown in the Service before you commit and may vary by region and currency.

Free trial

Where a free trial is offered, you may be required to provide a payment method at sign-up. Unless you cancel before the trial ends, your subscription will begin automatically and you will be charged the applicable subscription fee at the end of the trial.

Automatic renewal

All subscriptions renew automatically at the end of each billing period (monthly or annual) unless you cancel at least 24 hours before the end of the current period. The renewal price, billing frequency, and payment method will be the same as your current subscription unless we have notified you of a change in advance.

How to cancel

You can cancel your subscription at any time through the App Store (iOS) or Google Play (Android). Cancelling stops future renewals; access continues until the end of the current paid period. Uninstalling the app does not cancel your subscription.

Billing platform

All purchases are processed by Apple (for iOS) or Google (for Android). By subscribing, you also agree to the Apple Media Services Terms or the Google Play Terms of Service, as applicable. Labelz does not process card details directly.

8. Refunds and cancellations

Refund requests are handled by Apple and Google, not by Labelz. Please submit refund requests through:

You can submit content through the Service, including scan photos, ingredient text, data corrections, and product reports ("User Content"). You retain ownership of your User Content. By submitting it you grant Labelz a worldwide, royalty-free, non-exclusive, sublicensable licence to host, store, process, reproduce, adapt, create derivative works from, publish in aggregated or anonymised form, and use that User Content for the purposes of operating and improving the Service.

You represent that you have all rights necessary to grant this licence and that your User Content does not infringe the rights of any third party.

We may remove any User Content at our discretion, particularly where it appears to be inaccurate, abusive, off-topic or in breach of these Terms.

11. Intellectual property

The Service, including the Labelz name, logo, Panda mascot, all software code, ingredient database, UI design, copy, iconography, animations and audio assets, is owned by Labelz or its licensors and is protected by copyright, trade mark, and other intellectual property laws. No rights are granted to you other than a limited, personal, revocable, non-transferable licence to install and use the app on devices you own or control for your own non-commercial use.

All feedback, suggestions, ideas or improvements you provide to us about the Service may be used by us without obligation or compensation.

12. Third-party services

The Service integrates with and relies on third-party services, including Apple, Google, Supabase (our hosting and database provider), OCR and AI providers for ingredient parsing, RevenueCat (subscription management), and Expo (push notifications and runtime). We are not responsible for the content, practices, availability or performance of any third-party service. Your use of any third-party service may be governed by that provider's own terms and privacy policies.

External links or references in the Service are provided for convenience and do not imply endorsement.

13. Termination and account deletion

You can stop using the Service at any time and delete your account from inside the app (Settings → Delete Account). When you delete your account, we delete personal information as described in our Privacy Policy. Aggregated and anonymised data may be retained.

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have breached these Terms, if required by law, or if continuing to provide the Service to you would expose us to legal or security risk.

On termination, all licences granted to you under these Terms end. Sections that by their nature should survive termination will survive, including sections 5, 6, 10, 11, 14, 15, 16 and 17.

14. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, secure, accurate, complete, current, or fit for your particular purpose. We do not warrant that scan results, ingredient classifications, or verdicts are correct.

Nothing in these Terms is intended to exclude, restrict or modify any consumer rights or guarantees that cannot be excluded, restricted or modified under applicable law, including the Australian Consumer Law. Where such rights apply and cannot be excluded, our liability is limited, to the extent permitted, to resupplying the Service or paying the cost of resupply.

15. Limitation of liability

To the maximum extent permitted by law, Labelz, its directors, employees, contractors, agents, suppliers and licensors will not be liable for:

Where liability cannot be excluded under applicable law, our total aggregate liability to you arising out of or in connection with the Service is limited to the greater of (a) the amount you paid Labelz in the twelve months preceding the event giving rise to the claim, or (b) AUD 100.

You agree to indemnify, defend and hold harmless Labelz and its affiliates, directors, officers, employees, contractors, agents and licensors from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or in connection with:

These Terms are governed by the laws of Queensland, Australia. The courts of Queensland have exclusive jurisdiction to determine any dispute arising out of or in connection with these Terms, except that we may bring proceedings to protect our intellectual property in any court of competent jurisdiction.

Before commencing formal proceedings, you agree to contact us at contact@labelzai.app and attempt in good faith to resolve the dispute informally for a period of at least thirty (30) days.

Nothing in this section affects your non-excludable rights under applicable consumer law.

18. Changes to these Terms

We may update these Terms from time to time to reflect changes to the Service, legal requirements, or business practices. When we make a material change, we will update the "Last updated" date at the top of this page and, where appropriate, notify you in the app or by email. Your continued use of the Service after the updated Terms take effect constitutes acceptance of the new Terms.
